Subject: FK Moment - sort of

I watched a German TV Movie the other day which was called "Return of
the Black Buddha".
Its hero, and, yes, his name is Nick, gets his hands on this statue of a
black Buddha which brings doom on everyone who isn't the rightful owner
and which can tell the future.

Since the movie is from 2000 I kept wondering if its author watched a
certain show in the 90s.

Oh, GEEZ. I wonder if that counts as plaigarism. I did
a quick Google search to see if there was some sort of
an actual legend associated with "Black Buddha". Nope.
SOMEONE needs to talk to his/her muse about ORIGINAL
THEMES :)

International copyright and trademark laws are pretty
strict; I work in the Law and Corporate Affairs
recruiting group at my company and I do quite a bit of
research on it. Depending on the script, it may
actually be infringement. But, it is Sony's problem
not ours :)

If it was a copyright violation in the US, it most likely would be in Canada as
well, and vice versa.  But one has to remember that just because they both
contain vampires and a 'black Buddha,' it doesn't mean they are in other ways
alike. Otherwise, one could argue that Forever Knight  was a plagarism of PN Elrod's
vampire detective stories (the first of which was written pre-FK) or of Lee
Killough's, which may pre-date Elrod's (although Pat/PN didn't know of the
existence of Killough's books at the time). After all, the main characters are all
detectives who are vampires.

And who isn't to say that the movie script didn't pre-date the FK episode?
Scripts/ideas aren't always filmed immediately<g>

Most likely, you could even give several writers the subject of "vampire and
cursed Black Buddha" and you'll end up with majorly different stories from each
writer (although there may be elements which are the same). That's why fanfic
challenges are so much fun - challenge with an idea for a story and see how many
different ones the writers can post.
