It seems that the Wigmore Test is what is used in
Canadian courts regarding the whole religious
confidentiality issue and whether it violates the
Canadian Charter (Religous Freedoms):

While the value of freedom of religion, embodied in s.
2(a), is significant in particular cases, this value
need not necessarily be recognized in the form of a
prima facie privilege in order to give full effect to
the Charter guarantee.  The extent (if any) to which
disclosure of communications will infringe an
individual's freedom of religion depends on the
particular circumstances involved.  Relevant factors
include the nature of the communication, the purpose
for which it was made, the manner in which it was
made, and the parties to the communication.

                  The Wigmore test as to whether or
not a communications is privileged requires that:  (1)
the communications must originate in a confidence that
they will not be disclosed; (2) this element of
confidentiality must be essential to the full and
satisfactory maintenance of the relation between the
parties; (3) the relation must be one which in the
opinion of the community ought to be sedulously
fostered; and (4) the injury that would inure to the
relation by the disclosure of the communications must
be greater than the benefit thereby gained for the
correct disposal of litigation.  This test is
consistent with a principled approach to the question
which properly takes into account the particular
circumstances of each case.  These criteria are not
carved in stone and only provide a general framework
within which policy considerations and the
requirements of fact‑finding can be weighed and
balanced on the basis of their relative importance in
the particular case before the court.  They do not
preclude the identification of a new class on a
principled basis.

Based on
these criteria, I would think the seal of the
confessional would be inviolate in a court of law.

Hi Bonnie!

  Yeah, Ben did a guest shot last year on the final season of QAF
playing Ted's BF Tad ... the name was a constant source of joking
after that.  I told him that was fine as long as his last name wasn't
Pole.<g>

  He did say that the actor who played Ted (Scott Lowell) was a great
guy and very nice to work with.

I have some very unsettling news.

Knight Vision may have to shut down simply because a few jealous fans
decided to report me to Sony for copyright infringement. I have a fair idea
of who did this:

All 3 of them posted insults about my work in their journals and at a site
entitled del.icio.us  These occurred July 26th. Now, suddenly today I
receive a notice from Sony about copyright infringement. It's quite obvious
one or all 3 of them did this. Why? I can't imagine someone hating me and my
work so much they'd want to destroy me.

I am not sure what will happen yet. Sony may wish for me to shut down my
site or attempt to take me to court. I have been nothing but supportive of
this show for the last 7 years, but if some fans hate me that much I guess
it may be over.

If anyone has advice for me, please contact me offlist:

OMG!!!!  That is horrible!!!  And after you got to do the videos and
everything.
Maybe since Sony seems to like what you do, they can make it like an
official site or something.  Controlled content would be better than
no content.

Kristen - is it possible that since you were paid for
the videos you did you are now considered a
"professional" and can't be "ignored" the way they
have in the past?

Kristen,

Congratulations on Sony including your musical videos on Season 3.

Yes, this definitely sounds like jealousy, especially since your site has
been up and running for so many years. You get Sony to recognize your
talent, and instantly some fans complain?  Why not complain earlier, why
now? Of course it's jealousy!!! If we can be of any help to save your site,
please let us know.

This was about my "OLD" video dvd collection I used to offer to fans. It's
not about the new work I just did for Sony and this was from a whole
different department. A fan reported this. Sony does not take the time to
surf fansites, especially for an old cancelled series - Forever Knight -
*and* the DVD manager already knew about my site and even said I could
advertise the new dvds on it. That is why I believe a "fan" did this to me.
I also recently read some very suspicious messages from a few certain people
1 day before this happened.
