If you're ordering from Amazon.com, why not click to
it through the Forever Knight listing at
TVShowsonDVD.com.  They don't have a clickable link up
yet, but if you can wait a bit to preorder, I bet they
will soon.  Clicking through them to get to Amazon.com
supports TVShowsonDVD.com, which has been a great
resource for news on DVDs in FK and many other

He may have but in telling Father Rochefort he made him  complicit in his
cleansing of the church   He may even been pointing out to him in  a twisted
sense that  this something  he should have  taken care of himself.  I was
thinking from the point of view of Father Rochefort that  it would be  pure
torture  for him to  know that he could stop this man from doing what he was
doing  but only at the expense of  his own beliefs and everything he was.
He  couldn't help  but feel some sort of responsibility    for each death
that happened afterwards.

Am I the only one who didn't know that Ben Bass was on Queer As Folk?  I'm
watching the fifth season and he just walks in, saunters up to one of the

The first article she cites, Father William Saunders'

the absolute constraint placed on a priest in this situation.  He may speak
of something said to him in confession only if the penitent wishes him to do
so--which obviously is not true of the killer in "For I Have Sinned".
     In fact, according to Saunders, a priest is not even supposed to act on
what he has heard in a way that would "displease" the penitent.
     It strikes me that, in trying to warn Magda, Father Rochefort came *at
best* pretty perilously close to violating canon law.  His warning her would
surely "displease" the killer!  (Mind you, I don't imagine anyone in the
story would be about to complain to an ecclesiastical court.)

However, the second article Mary cites
(http://www.newadvent.org/cathen/13649b.htm) is interesting because it
describes the history of the interaction of ecclesiastical and state law in
this matter--mostly with reference to English common law.
     As she points out, the article was written almost a hundred years ago,
and is hence out of date.   At that time, some jurisdictions--and the
article cites some American states as examples--did indeed have statutes
that exempted priests from having to testify about things told them in
confession.  However, there was *no* privileged communication for priests in
the various legal sysems in Britain.  The fact that this article is so old
may well mean that it is out of date on this point.  But it is definite that
there was (then) no statute explicitly conferring privilege on priests under
English law, nor did they have such privilege under English common law.
     And, at that time, the same was true in Canada.
     I've tried checking online to see if I can find out what the situation
is today; but I can't particularly find anything one way or the other.  So I
don't know whether there may (or may not) be some current statute in
Canadian law permitting priests to refuse to testify on the basis of
confidentiality.
     Of course, I'm not a lawyer.  (Any Canadian lawyers out there?)
     .
One thing is clear:  there have certainly been cases in the past where an
*English* court has required a priest to reveal something he learned in
confession.  Each time it happened, the priest refused to do so, and was
imprisoned for contempt of court.

Now, none of those cases cited in the encyclopedia article involved a
serious offence.  And it is here, particularly, that the ethical question
becomes significant.  The article makes frequent reference to "public
policy", and points out that strictures on the Catholic church eased a lot
towards the end of the nineteenth century once Catholicism ceased to be
proscribed or restricted under English law.  This means that public policy
in the twentieth century might be expected to run increasingly towards
*accepting* the Catholic church's position on the privileged position of
priests when it comes to not having to testify.
     But "public policy" also mandates the preservation of public safety.  It
is noticeable that the article cites one quite early legal authority who
held that there were circumstances in which priests should not have
privilege--notably where high treason was involved, because of the threat to
the public weal.
     Well, a serial killer certainly also threatens public safety!  How many
people would still support Rochefort's refusal to help the police if there
had been further murders?

He did have a choice to speak.  He chose not to; but he *could* have.

The ethical issues surrounding his refusal were not really addressed in "For
I Have Sinned".  It was written in such a way that Rochefort's silence did
not affect the outcome of the story:  there were no further victims; so the
*potential* consequences were avoided, and Rochefort thus avoided any
specific blame.
     And, of course, the story was about faith:  his and Joan's, and how they
impacted on Nick's own blighted certainties.  So the writers did not want to
come up with circumstances in which his silence would have negative
consequences.  They wanted Rochefort's silence to confirm his faith, since
that was the theme.

So the ethical issues were not the point of the episode--that doesn't mean
that they don't arise.  Should the writers have slanted the story the way
they did?  Basically, by contriving it so that Rochefort's silence had no
bad results, they avoided the ethical issues; and thus they certainly did
slant the story.
