Okay, okay...I'm not going NoMail.  Thanks to all who e-mailed their
concern. <g>
But I'm not feeling up to doing outrageous posting right now.  Had a bad
work week--scratch that---month, then I thought I'd done something
disastrous onlist and it turned out nought.  (Mixed blessings in that as I
now feel I've gone qwakers ala Nick in Curioser & Curioser.)  Methinks Brain
has put in a vacation request in a way that got my attention like a nuclear
bomb and I dare not ignore it.

So, carry on, McDuffs... Kyer will be reading.  She just needs to give
herself a rest is all.  Catch up on missed sleep.

Subject: Understanding What Nick and Nat Do and How They Do It.

Hello,

I am de-lurking for the moment.
I hope this is ok.
For those interested and may
not know, on the HBO site,
there is a virtual autopsy.
They take you through a crime
scene, gathering clues.
It's pretty neat, but it may disturb
some. But it could help anyone
wanting to write a crime portion
of a good FK story. It lets you
help solve the crime, step by step.
I hope this isn't OT, I thought it might
help in understanding what Nick goes thru
as well as Natalie's part in the whole picture
of things. There is a lot I never thought about.

 My husband and I have been following the whole 'Napster' thing and last
night he made the comment that as soon as this is settled, companies are
going to start going after the writers of 'fanfic'.  He said that it is
all about money and that if they aren't making money off of it, they
don't want anyone to be able to enjoy it.
 As a fanfic writer, this has me thinking.  I would be heartbroken to
lose our wonderful fanfiction sites and not be able to get anymore
Forever Knight at all!
 Any thoughts on this?

I wouldn't worry about it. Although it is a similar nature, it isn't totally the
same. Napster concerns ORIGINAL music, not music based on the music Napster is
allowing the "sharing" of.

There are some shows and movies that have cracked down on fanfic, but most don't
see it as much of a threat. Fan fic technically is illegal, but one could argue
it has been allowed for this long so it must be seen as "okay" in the eyes of
TPTB.

The reason we occasionally hear of a crackdown on a fanzine or something, in my
opinion at least, is when it is a more professionally looking "book" or
advertised as a "novel" instead of fanfic.

one of the arguments I've heard FOR Napster is that fans have always copied
music off the radio, etc. However, as I heard explained on the radio by an
attorney, when you do that it is for your own use or maybe for a few friends.
When it is on the Internet, it is for "five million of your closest friends."
The music industry probably is losing money, and the creator's are losing money
as well.

Fan fic is different.

That's not the same thing as FK fan fic. Creators are paid a fee, normally, for
each CD or cassette sold. It isn't a matter of "being able to enjoy it" it is a
matter of making a living. No one is making money off of fan fic.

So there's no need to lose any sleep over us losing our Forever Knight fanfic
stories. If there was a concern, they'd have told use to quit years ago.

As a professional writer, I'm very concerned about hanging onto my copyrights
and characters, so I've given a lot of thoughts concerning Napster, fanfic, and
my professional stories that are up on the Net thanks to my publisher.

 Well, in our case, we have been using Napster to put our old records
(the ones we can't find on CD) onto CD's, just for our own use.  There
have also been times when my kids wanted a particular CD and we've
listened to one (or all) of the songs on that CD, before deciding whether
or not to purchase it for our kids. We don't just simply download an
album and make a CD of it, because we don't feel that is fair to the
artist(s) (we don't particularly care about the record companies).
 I agree that the fanfic sites aren't a 'danger' to any of the companies
involved with FK (or any of the other shows I've seen), since no one
makes any money off of them. But my husband always has to be right, so I
just let him say what he thinks and I don't argue with him.
 I love FK fanfic, since it allows people to be creative, silly or get
something out of their system (as I have often done).
 The only other thing my husband said might cause a problem, is our FK
'merchandise' that people can buy online through some of the fans.  My
understanding is that they don't make a profit, they just charge for the
cost of making the item and for shipping. He insists that somewhere along
the line *someone* is making a profit. Again, I don't argue, I just let
him think what he likes.
 I'm not stressing over it. I was just wondering what others thought on
the subject.

I think fanfic is probably still relativly safe.

While the whole Napster thing is about money, I think it's more about
potentially losing money, rather than not making money. Unless Sony
suddenly becomes interested in making money off FK, the existance of
fanfic isn't hurting them monetarily, so why spend money going after
us?

Besides, they didn't go after fanfic when they released the FK novels.
